Legal Facts

According to the Austrian State Law BGBL Nr. 275/1992 concerning the control rules of the medical assisted reproduction (Fortpflanzungsmedizingesetz-FmedG) and the Austrian Civil Code, the marriage law and the jurisdiction were changed, and now allow:

  • Sperm (also donor sperm) to be placed into the genital organs of a woman.
  • Egg and sperm cells may be united outside the woman’s body.
  • Cells capable of developing may be placed in the uterus or fallopian tubes of a woman.
  •  Egg cells; respectively egg cells with sperm may be placed in the uterus or fallopian tubes of a woman.
This became law on the 1st of July 1992. Medical assisted reproduction is only possible when the couple are married or live together in a relationship. The law requires proof in the form of a marriage certificate or a notary file (by a relationship, donor sperm). Please understand that we need these documents because we are bound by law.

Please bring your marriage certificate on your first appointment. We can help couples that live in relationships by giving them the address of a notary in Bregenz, who will deal with all the formalities

The IVF-Funds-Law came into effect on the 1st of January 2000 in Austria. Under certain conditions (blocked fallopian tubes, poor sperm quality, women under the age of 40yrs, man under the age of 50yrs) 70% of the costs for IVF /ICSI treatment and medication are paid for by the IVF Fond in Austria. Details can be obtained from the institute.
